PETITION
TO THE HONOURABLE THE PRESIDENT AND MEMBERS OF THE LEGISLATIVE COUNCIL OF NEW SOUTH WALES
The Petition of certain citizens of New South Wales state that:
The ‘Crimes (Criminal Organisations Control) Act and Amendments 2009’ was introduced without adequate parliamentary debate and little, if any, public consultation. Normal parliamentary procedure was abandoned with the Parliamentary Review Committee being excluded from the process until after the act was passed.
The ‘Crimes (Criminal Organisations Control) Act and Amendments 2009’ is an unnecessary and draconian piece of legislation which among other things,
- Compromises the independence of the judiciary
- Allows secret evidence or so called criminal intelligence
- Disregards the rules of evidence
- Changes the way a decision is made from “beyond reasonable doubt” to “on the balance of probabilities”
- Excuses the Judge from providing reasons for his/her decisions
- Contravenes sections of the United Nations Declaration of Human Rights, which uphold our right to work and associate
Your petitioners request that the House will repeal The ‘Crimes (Criminal Organisations Control) Act and Amendments 2009’ as a matter of priority.
